AI has become the headline of modern marketing. And with it comes a wave of bold claims about accuracy, automation, speed, and performance. But these claims are now heavily scrutinized, and marketers must know exactly where the compliance boundaries are.

Let’s break down the dos and don’ts of content about AI: what you can confidently say, what requires qualifications, and where brands often unintentionally cross regulatory lines. Together with digital marketing and advertising agency AI Digital, we review a real example of AI-related copy to show how to communicate AI capabilities in a way that attracts customers, builds trust, and stays fully compliant.

DOs — responsible content about AI

When talking about AI, the strongest messages are both compelling and carefully grounded. Marketers don’t need to dilute the impact of their copy: they simply need to frame AI capabilities in a way that reflects how the technology actually works. Below are the key DOs that help teams communicate AI responsibly while staying clear, truthful, and compliant.

  • Be specific, not absolute — replace “guarantees” with clear descriptions of what the tool is designed to support.
  • Use evidence when mentioning results — reference methodology, data sources, time ranges, or benchmarks when citing performance.
  • Clarify variability of outcomes — add qualifiers like “may vary by use case, industry, dataset, or level of adoption.”
  • Explain what the technology can do and why — focus on mechanisms (“predictive models analyze X…”) rather than promises.
  • Maintain human-centered framing — emphasize collaboration between humans and AI, not replacement of humans.
  • Provide transparency and nuance — include context on benefits, limitations, required inputs, and dependencies.
  • Use neutral and measurable language — “designed to support,” “based on data,” “improves decision-making when…”
  • Align expectations with the customer journey — make clear when AI informs decisions rather than decides autonomously.

DON’Ts — risky content about AI

Just as important as knowing what to emphasize is knowing what to avoid. Certain types of AI claims can quickly slip into overstatement, ambiguity, or regulatory risk — often without marketers realizing it. Below are the key DON’Ts that help teams prevent misleading impressions, unsupported promises, and compliance red flags.

  • Don’t imply guaranteed ROI or business outcomes — performance claims without substantiation trigger compliance risk.
  • Don’t over-promise accuracy, automation or safety — avoid statements suggesting the AI is flawless or error-proof.
  • Don’t present AI as replacing legal, regulatory or human oversight — regulators reject messaging that promotes “fully autonomous” decisions.
  • Don’t claim universal effectiveness — wording like “works for everyone,” “in every industry,” “in any campaign” is high-risk.
  • Don’t use hype language without qualifiers — “zero-second decisions,” “beyond human ability,” “perfect accuracy,” etc., can violate truth-in-advertising rules.
  • Don’t hide limitations or dependencies — if performance depends on inputs, users, datasets or configurations, say so.
  • Don’t position AI as removing responsibility — avoid narratives that suggest AI eliminates due diligence, compliance or accountability.

Reviewing a social media post with Inspack

AI Digital shared with us an example of their social media copy describing their AI-powered software. We ran it through Inspack to see whether every claim meets FTC standards for truthfulness, substantiation, and transparency. In this section, we walk through how the tool analyzes risk signals, identifies statements that may require qualification, and offers compliant alternatives without diluting the original message.

For us, strategy is not empty words: we back it up with data.

We don't just talk about the need for AI strategy — we publish the data on it. Our Ad Agency AI Adoption Report reveals that 66% of agencies are stalled, mainly due to skills and governance gaps.

Releasing this report is a major step in our commitment to solving those challenges, proving that operational rigor and talent investment define competitive success. As our Chief AI Officer, David Mainiero, stresses: leaders must act now.

Sofia Mishina, Talent Acquisition Director at AI Digital, comments:

“Talking about AI today means walking a fine line. Between hype and fear, innovation and uncertainty, there’s not much room left for clarity. That’s exactly why ethical communication matters, it’s what separates responsible brands from the noise.

‍At AI Digital, we believe every message about AI should do three things: inform honestly, empower responsibly and stay human. Ethical AI communication is about telling the truth with context.

‍We’ve learned that transparency builds trust faster than any tagline. When we speak about AI, whether it’s automating workflows or transforming media buying, we explain both the benefits and the limitations. Because AI doesn’t replace people, it changes what people are capable of. And that shift demands communication that’s clear, accurate and human-centered.”
